Service Agreement
By obtaining services from SPACE DIGITAL BILISIM LIMITED COMPANY RuzgarHost Website (www.RuzgarHost.com), you agree to all the terms in this agreement. RuzgarHost is not legally or criminally responsible for any material or moral damage arising from not reading these terms or not acting in accordance with them, nor are the creators of any content on this site, its employees, or any persons and organizations authorized by RuzgarHost.
RuzgarHost reserves the right to update and change this agreement at any time without prior notice.
All information, statistical figures and values on the RuzgarHost Website are compiled from sources deemed reliable within general practices, and their accuracy and adequacy are not guaranteed by RuzgarHost in any way. RuzgarHost is not legally or criminally responsible for any direct or indirect material and/or moral damages and/or any possible other damages and costs that may arise from the use of information, evaluations, comments, and statistical shapes and values on the RuzgarHost website.
Before receiving services from RuzgarHost, it is assumed and accepted by you that you have read the warnings and declarations in this agreement, and in case of any dispute, claim, and demand, the statements written on this web page and all other computer records belonging to RuzgarHost will be presented as the sole and exclusive evidence by RuzgarHost and accepted and undertaken by the person(s) and organization(s) entering this RuzgarHost Website.
1.) Orders and Service Delivery
Your account will be set up and your information sent to you after your order passes fraud checks and your payment is received. While domain name, web hosting, and reseller hosting accounts are automatically set up for payments made via credit card and PayPal, setup can take up to 48 hours in case of any issues. For payments made via bank and postal check transfers to our accounts, setup time is defined as a maximum of 2 business days. For VDS and dedicated server services, unless stated otherwise, setup time is 48 hours. Delivery time for software and license services is a maximum of 1 week, unless otherwise stated in writing/verbally. If delivery is not made within the specified time frame, RuzgarHost is obliged to refund your payment upon request.
It is your responsibility to provide an actively used, problem-free email address during the order. This email address will be used in case of any rule violations or when we need to contact you. Keeping your email address updated and regularly checking it is your responsibility; all emails sent to you are considered delivered. RuzgarHost is not legally or criminally responsible for any damages resulting from non-receipt of emails or failure on your part to read them.
All information in the form you fill out during the order or registration on our site must be accurate and complete. RuzgarHost reserves the right not to refund or to partially refund for orders canceled due to incorrect information. RuzgarHost may request a copy/scan of your credit card or ID for security reasons in some cases. Failure to provide these may result in your order being canceled as fraudulent or suspension of your service(s). For accounts suspended due to fraud, RuzgarHost reserves the right not to refund or to partially refund.
Site Migration
In services where site migration is guaranteed, RuzgarHost does its best to migrate your site to RuzgarHost. However, since site migration is an uncertain process, RuzgarHost does not guarantee that your site will be migrated or how long the migration will take. Each hosting company has a different configuration and/or some hosting companies do not meet the necessary conditions for site migration, making it very difficult or impossible to migrate your site accurately/incompletely/error-free. Your site may be migrated incorrectly and/or may not be migrated at all. RuzgarHost is not legally or criminally responsible for any damages arising from this situation.
2.) Content
All services provided by RuzgarHost are regulated according to the Constitution of the Republic of Turkey.
You cannot impose any legal responsibility on RuzgarHost by using the services provided by RuzgarHost; you are legally responsible for all actions you take using the services provided to you.
It is prohibited to act against any copyright or trademark rights using our services. This includes unauthorized music, books, photos, or other copyrighted materials. Additionally, it is illegal to host pornographic/erotic content and content that can be used for hacking according to laws. Hosting such content will result in the immediate termination of your service(s). If copyright/trademark rights are violated and/or pornographic/erotic content is hosted, the content will be deleted or access to the content will be blocked. In case of repetition, the service may be suspended/terminated. If you believe that content violating these rules is being hosted using the services provided by RuzgarHost, you can file a complaint by sending an email to support@ruzgarhost.com. RuzgarHost may request additional information/documents from you regarding your complaint.
In complaints about illegal actions taken using the services provided by RuzgarHost, if RuzgarHost cannot verify the cause of the complaint or is unsure whether the action constitutes a crime, the service may not be terminated. RuzgarHost does not have the authority to make legal decisions. In such cases, you must seek your rights legally against the person who performed the action. RuzgarHost is not legally or criminally responsible for any damages that may occur in such cases.
All services provided by RuzgarHost are for use within the limits permitted to you. If you access any content/file/service you are not permitted to use, it is your responsibility to report this to RuzgarHost without using it. Otherwise, you are responsible for compensating for any material/moral damages that may occur.
RuzgarHost may monitor site contents and/or all kinds of access for legal reasons, for system management, to track unauthorized entry, to verify security procedures, and/or for operational security. During monitoring, contents/information may be tested, recorded, copied, or used for the purposes described above. RuzgarHost will not use or share your content for any purpose other than those described above.
RuzgarHost reserves the right to provide services to anyone or to refuse service to anyone. RuzgarHost has the right to delete/prohibit access to content that is contrary to the agreement, provocative, divisive, illegal, or deemed inappropriate, with or without warning. In such cases, RuzgarHost reserves the right not to refund or to partially refund.
Illegal content will be reported to the authorities.
Uploading content that can damage RuzgarHost servers, such as viruses and shell scripts, will result in the immediate termination of your account without a refund. You are responsible for compensating for all material/moral damages caused to RuzgarHost and/or other users in this way. Ensuring the security of your account is entirely your responsibility.
In the services you receive from RuzgarHost, you are responsible for ensuring that the software/scripts/programs loaded onto your account are secure and that the permissions given to directories are correct. Users are responsible for all operations performed in their accounts. This responsibility includes the username and password. You must use a secure and unpredictable password for your accounts. Additionally, you are responsible for all malicious software that may be uploaded to our servers using your account. In necessary cases, RuzgarHost has the right to terminate your services without refunding or partially refunding your payment. RuzgarHost will not accept legal or criminal responsibility for any material/moral damages that may occur in this regard. You are responsible for compensating for all material/moral damages caused to RuzgarHost and/or other users using your account.
RuzgarHost reserves the right to request modifications to any website, database, account, or any other material/service from you.
3.) SPAM Ban
RuzgarHost strictly does not tolerate unwanted email sending, mass email sending, and spam emails. If you violate this rule, your service(s) will be terminated, with or without notice. All services causing our IP block to be blacklisted will be terminated without notice.
RuzgarHost reserves the right to demand the necessary fee from the person responsible for causing our IP block to be blacklisted. This fee is independent of RuzgarHost and will be used for the removal of our IP block from email blacklists. By receiving services from us, you agree to pay the required fee without objection within the requested timeframe in such cases.
4.) Payment
As long as you receive services from RuzgarHost, you agree to pay the fee for the service to RuzgarHost. Unless you cancel the service you have received, the service will continue to be renewed, and an invoice will be generated for the service you receive. If you do not wish to continue receiving the service, you must indicate your desire to cancel at least 15 days in advance, so that your service can be canceled at the end of the day or after the period for which you have paid.
Service cancellation must be done through your customer panel. The cancellation page has the necessary options for immediate cancellation or cancellation at the end of the period.
If not canceled 15 days in advance, RuzgarHost reserves the right to secure the fee through legal means for accounts whose payment has not been made.
As long as you receive services from RuzgarHost, it is your responsibility to ensure that your payment information is up to date and to pay your invoices on time. If the invoice is not paid on time, RuzgarHost will give an additional 6 days for web hosting and reseller hosting accounts to make the payment, after which your service will be suspended. If the payment is not made within 30 days from the last payment date, the service you receive will be terminated. For domain name, VDS, and dedicated server services, your accounts will be immediately terminated if payment is not made on the last payment day. RuzgarHost cannot be held responsible for any material/moral damages or data losses that may occur in this regard.
Overpayments made accidentally and/or knowingly will be added as credit to your account, and no refunds will be made for any reason. You can use this credit for future services you receive from RuzgarHost.
RuzgarHost reserves the right to change the prices of products at any time without notice.
RuzgarHost will demand the fee for the used resources if the disk space, traffic, and similar resources purchased exceed the purchased amount. In such a case, it is your responsibility to pay the required fee without objection within the requested timeframe. If not paid, your account will be terminated without refund, and RuzgarHost will not be responsible for any material/moral damages and data losses that may occur in this regard.
You are responsible for compensating for all material and moral damages caused to RuzgarHost in cases of chargebacks (dispute, chargeback, etc.) conducted without the knowledge and/or permission of RuzgarHost, using payment channels.
5.) Backup and Data Loss
You are responsible for all your data while using our services. RuzgarHost provides backup service as a convenience to you and does not guarantee backups in any way. RuzgarHost cannot be held responsible for any data losses you may experience for any reason.
6.) Service Cancellation and Refund
RuzgarHost reserves the right to terminate any service, without refund or with partial refund, without cause, at any time, with or without notice.
Insulting/behaving rudely towards any of our employees will result in the suspension/termination of your account/service(s). In such a case, your membership will be terminated without any refund, and the agreement will be terminated.
If you receive services from RuzgarHost, you commit to refraining from any comments, behaviors, advertisements, banners, writings, words, etc., that may harm the commercial reputation of RuzgarHost or its employees. In case of contrary behavior, you accept that you are under the obligation of material-moral compensation and that Istanbul Courts and Enforcement Offices have jurisdiction in all lawsuits that may be opened in this case.
Sites that indirectly or directly cause damage to our servers and/or lead to slowdowns/interruptions, such as being targeted by attacks, can be terminated without notice and without refund. In such cases, RuzgarHost may demand that you compensate for the damage. In such a case, it is your responsibility to pay the required fee without objection within the requested timeframe.
For services paid for, if the service is canceled before the service period ends (due to breach of service agreement, user request, etc.), the full or unused portion of the service fee will not be refunded. You can use the credit in your account for services you can receive from us, but refunds will not be made or credited to your account for services terminated early.
7a.) Use of Service
7aa.) Web Hosting/Reseller Hosting
Prohibited actions:
a) Sending mass emails and SPAM mail in any way and for any reason is strictly prohibited. Email services are provided for your normal correspondence only.
b) Resource usage exceeding 25% for more than 90 seconds is prohibited. Many activities can cause this problem, including CGI scripts, FTP, PHP, HTTP, etc. Resource usage reports are identified by RuzgarHost, and RuzgarHost is not obliged to provide any proof regarding your resource usage.
c) Exceeding an average daily resource usage of more than 5% for web hosting accounts and more than 12% for reseller hosting accounts is prohibited. Many activities can cause this problem, including CGI scripts, FTP, PHP, HTTP, etc. Resource usage reports are identified by RuzgarHost, and RuzgarHost is not obliged to provide any proof regarding your resource usage.
d) Running any server-based programs on our servers is prohibited. This includes server-based programs like IRC.
e) Running spider or indexer programs like Google Cash/AdSpy is prohibited.
f) Running any software that communicates with IRC (Internet Relay Chat) networks is prohibited.
g) Running any proxy applications is prohibited.
h) Running any bit torrent applications is prohibited. You may provide external links to legal torrents but cannot host them on our servers.
i) Running any file sharing/peer-to-peer applications is prohibited.
j) Running game server applications like Counter-Strike, Half-Life, etc., is prohibited.
k) Running cron jobs at intervals shorter than 15 minutes is prohibited.
l) Running file-sharing software is prohibited (e.g., rapidshare).
m) Running audio stream/video broadcast applications is prohibited.
n) Each web hosting account is limited to a maximum of 250,000 files. Accounts with more than 100,000 files will not be backed up by us.
7ab.) VDS/Dedicated Server
Prohibited actions:
a) Sending mass emails and SPAM mail in any way and for any reason is strictly prohibited. Email services are provided for your normal correspondence only.
b) In VDS services, intense resource usage that can harm other VDSs is prohibited. This problem is generally caused by intense disk activities.
c) Running any proxy applications is prohibited.
d) Running any bit torrent applications is prohibited. You may provide external links to legal torrents but cannot host them on our servers.
e) Running any file sharing/peer-to-peer applications is prohibited.
f) Running game server applications like Knight Online, Counter-Strike, Half-Life, etc., is prohibited.
7b.) Backup Limit
Customers making backups deemed unnecessary by RuzgarHost continuously can have their service(s) suspended/terminated, with or without notice. This clause applies when the backup service is used beyond its intended purpose, causing harm to the server.
7c.) Unlimited Web Hosting
a) Unlimited web hosting services are intended only for hosting your website files and only cover your website traffic.
b) Unlimited web hosting space cannot be used for data storage and/or backup purposes.
8.) Traffic Usage
You will have a certain traffic limit according to the package you purchase. If this limit is reached/exceeded, the purchased service(s) can be automatically suspended until the next month or until more traffic is purchased. It is your responsibility to monitor the used traffic. Unused traffic cannot be carried over to the next month. Usage over the purchased traffic will be billed the following month, and you agree to pay this fee without objection within the requested timeframe.
9.) Uptime Guarantee
If the 99% uptime guarantee promised by RuzgarHost is not met, RuzgarHost is responsible for providing one month of free use for the relevant service upon your request. Uptime reports from third-party monitoring software are not valid for RuzgarHost; RuzgarHost maintains and publishes its uptime reports. To add credit to your account in case of non-compliance with the uptime guarantee, you should send an email to support@ruzgarhost.com. For VDS and dedicated server services, the guarantee is only for the network; RuzgarHost is not responsible for the operational and/or accessible condition of your VDS or dedicated server. In such cases, RuzgarHost will not be aware of the problem unless you report it. The discount provided for VDS/Dedicated server services in case of non-compliance with the uptime guarantee does not cover 3rd party software/license fees.
The uptime guarantee does not apply during attacks intended to shut down the server by malicious individuals and during previously announced server maintenance. Interruptions caused by these reasons will not be reflected in the uptime rate.
10a.) Scope of Support
You accept that RuzgarHost will not provide support for matters not covered by the service you received. RuzgarHost is not obliged to provide software support or perform user operations (creating mail accounts/setting up mail, creating databases, etc.) for any hosting service received. In VDS/dedicated server services, support is provided only for restoring the system to its original delivery state; additional software installations-user operations are not included in the support scope. In software services, RuzgarHost is only obliged to deliver a software that operates without issues.
To benefit from the support system, you need to log in to your customer panel with your password and send a support ticket from the Support Notifications section. No information about the account will be shared, and no action will be taken through other methods (email, phone, live support, contact form, etc.).
10b.) 24/7 Support and Support Response Time
The concept of 24/7 support does not mean that you will reach someone by phone every time you call/receive an immediate response to your support notifications. Our support team tries to respond to your notifications as quickly as possible. 24/7 support indicates that we operate outside of regular business hours, and the response time to your support notification will be a maximum of 24 hours, barring exceptional circumstances.
11.) Reseller Hosting: Customer Responsibility
If you have a reseller hosting account, you are responsible for providing support to your own customers. RuzgarHost will not provide support to the customers of reseller hosting users. If any customer of our reseller hosting users contacts us, RuzgarHost has the right to suspend your account until you deal with your customer. Additionally, our reseller hosting users are responsible for the content of their customers' sites. RuzgarHost cannot be held responsible in any way for illegal actions and contract violations of the customers of reseller hosting users.
12.) VDS and Dedicated Server
RuzgarHost reserves the right to reset the password of any VDS or dedicated server service it provides. Keeping a valid email address and the root password recorded in our system is the customer's responsibility. VDS and dedicated servers are not backed up by us; all data and backups are the customer's responsibility.
13.) Co-Location (Server Hosting)
RuzgarHost reserves the right to reset the password of any server hosting service it provides. Keeping a valid email address and the root password recorded in our system is the customer's responsibility. Hosting services are not backed up by us; all data and backups are the customer's responsibility.
RuzgarHost reserves the right to hold the hosted server and other equipment as collateral until the payment is made with legal interest in case of payment delays in server hosting services.
14.) Price Changes
For the service you purchased, no additional fee will be demanded from you during the service period you purchased, unless you purchase an additional feature or exceed the limits allowed to you. RuzgarHost reserves the right to change prices at the end of the service period and renew the service with the new pricing.
15a.) Compensation
By receiving services from RuzgarHost, you agree not to cause any material or moral damage to RuzgarHost and to compensate for any material/moral damage caused.
15b.) Legal Obligations
By receiving services from RuzgarHost, you agree not to impose any legal obligations on RuzgarHost. In such a case, you commit to covering all court and attorney fees within the requested timeframe.
16.) Waiver
RuzgarHost cannot be held responsible for any damage to your business. RuzgarHost does not provide any warranty for the service(s) it offers. This includes data losses, delays, interruptions, incorrect information delivery caused by RuzgarHost or any RuzgarHost officer. RuzgarHost will not accept responsibility if your data/information is obtained by third parties in the event of a hack.
17) Legal Information Disclosure
RuzgarHost is obligated to provide any requested information to legal authorities in necessary situations. This information may include your private information in necessary situations.
